A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §17C-4-17, relating to traffic accidents involving a motor carrier regulated by the Public Service Commission.

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §17C-4-17, to read as follows:
ARTICLE 4. ACCIDENTS.
§17C-4-17. Accidents involving a motor carrier regulated by the Public Service Commission.

In the case of a traffic accident involving a motor carrier regulated by the Public Service Commission and in which an individual suffers severe bodily injury or death, a Public Service Commission investigator must be summoned to the scene of the
accident and, if no Public Service Commission investigator is available, all vehicles involved in the accident must be impounded by the law-enforcement agency investigating the accident until such time a Public Service Commission investigator can investigate and examine the vehicles involved in the accident.

NOTE: The purpose of this bill is to provide for a Public Service Commission investigator for traffic accidents involving a motor carrier regulated by the Public Service Commission and in which an individual suffers severe bodily injury or death.
